Terms of Service
Effective date: October 4, 2026
In short: TalkingDot is free to use within fair-use limits. You own your content, you are responsible for how you use the messenger on your website and for your visitors' data, and the service is provided "as is", without an uptime guarantee.
Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and TalkingDot ("we", "us", "our"), the operator of TalkingDot at https://talkingdot.com. By creating an account, joining a workspace or otherwise using the service, you agree to these Terms, to our Acceptable Use Policy and, where you process your visitors' personal data, to our Data Processing Addendum.
If you use TalkingDot on behalf of a company or other organisation, you confirm that you have authority to accept these Terms for it, and "you" includes that organisation.
The service
TalkingDot provides live chat software as an online service. It includes a messenger you can add to websites, a hosted chat page, a shared inbox, contacts, chatbots and automation, a help center, proactive messages, reports, a REST API and webhooks. We may add, change or remove features over time.
Accounts and eligibility
- You must be at least 16 years old and able to form a binding contract to create an account.
- Give accurate information and keep your email address up to date, because we use it for important notices. We may ask you to verify your email address before your messenger goes live.
- Keep your password safe and do not share your login. Each person should have their own account. We strongly recommend turning on two-factor authentication.
- You are responsible for activity under your account. Tell us promptly at support@talkingdot.com if you suspect unauthorised access.
Workspaces and teammates
Each workspace has its own messenger, inbox, contacts, help center and settings. The person who creates a workspace is its owner. Owners can invite teammates as admins or agents, change their roles and remove them.
- The owner is responsible for the workspace, including who has access to it, how teammates use it and its settings, such as IP storage, data retention and the domain allow-list.
- Teammates must follow these Terms. Invite only people who need access and remove access when someone leaves.
- Depending on their role, everyone in a workspace may be able to see its conversations, contacts and notes.
Free service and fair-use limits
TalkingDot is free. There is no seat pricing and we do not ask for a payment card. You will never be charged unless you have agreed to it in advance.
To keep the service fair and sustainable, we set fair-use limits, which may include:
- the maximum size of each attachment and the file types allowed;
- the total attachment storage per workspace;
- the number of workspaces each account can create and the number of teammates per workspace;
- rate limits on messages, new visitor profiles, sign-in attempts and API requests.
When you reach a limit, some actions, such as uploading files, may be refused until you are back under it. We may change limits, and will give reasonable notice before reducing one in a way that significantly affects existing workspaces, unless we must act sooner to stop abuse.
Acceptable use
You must use TalkingDot lawfully and in line with our Acceptable Use Policy, which forms part of these Terms. In particular, do not use it for spam, phishing, malware or illegal content, and do not install the messenger on websites you do not control.
Your visitors' data and your responsibilities
When you install the messenger, you collect personal data about your website visitors, leads and users ("Customer Data"). For Customer Data, you are the controller and we are your processor. Our Data Processing Addendum applies and forms part of these Terms.
You are responsible for:
- having a privacy notice on your website that explains your use of live chat and names us as a service provider;
- having a lawful basis for the data you collect and the messages you send, and obtaining any consent your visitors' local law requires, including for the messenger's visitor token stored in their browser;
- choosing appropriate workspace settings, such as IP storage, conversation retention and identity verification for signed-in users;
- not asking visitors to send special categories of data (such as health information), full payment card numbers or passwords through the messenger, unless you have a lawful basis and appropriate safeguards;
- answering requests from your visitors about their data, using the export and erasure tools we provide.
Your content and our rights
You keep all rights to the content you and your teammates add to TalkingDot and to your Customer Data. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display and otherwise process that content only as needed to provide, secure and support the service, and as described in our Privacy Policy and Data Processing Addendum. This licence ends when the content is deleted from the service, apart from copies in backups until they are overwritten.
You confirm that you have the rights needed for the content you add.
We own the TalkingDot service, software, design and brand. We give you a limited, non-exclusive, non-transferable right to use the service under these Terms. The messenger may show a "Powered by" line; do not hide or change it unless a workspace setting allows you to. If you send us feedback or ideas, we may use them without any obligation to you.
Integrations, API and third-party services
You can connect TalkingDot to other services, for example through webhooks, the REST API or Slack, Discord and Telegram notifications. Data you send to those services leaves TalkingDot and is governed by their terms, and you are responsible for those connections. Keep API keys and webhook secrets confidential and stay within the API rate limits. We may revoke keys or disable webhooks that are compromised or used abusively.
Availability and support
We work to keep TalkingDot available and reliable, but because the service is free it is provided without a service level agreement or uptime guarantee. It may be interrupted for maintenance, updates or events outside our control. You can check the current status on our status page.
We offer support on a reasonable-efforts basis at support@talkingdot.com and through our contact form. Keep your own copies of any data you cannot afford to lose; you can export contacts and reports at any time.
Suspension and termination
You can stop using TalkingDot at any time. Workspace owners can delete a workspace in its settings (General → Danger zone), and you can close your account yourself under Account → Delete account. If you need help, contact us at support@talkingdot.com from the email address on the account.
We may suspend or terminate an account or workspace, or remove content, if we reasonably believe that you have breached these Terms or the Acceptable Use Policy, that your use creates a security, legal or reputational risk, or that the law requires us to. Where reasonable, we will tell you why and give you a chance to fix the problem first, but we may act immediately in serious cases such as spam, phishing, malware or illegal content.
When an account or workspace is closed, its data is deleted as described in our Privacy Policy, so export anything you want to keep first. Sections that by their nature should survive termination, such as disclaimers, limitation of liability and governing law, continue to apply.
Changes to the service and these Terms
We may change TalkingDot and these Terms from time to time. Where we reasonably can, we will give advance notice before removing a significant feature. If a change to these Terms is significant, we will tell account holders by email or with a notice in the dashboard at least 30 days before it takes effect, unless the change is needed sooner for legal or security reasons. If you continue to use the service after a change takes effect, you accept the updated Terms; if you do not agree, you should stop using the service.
Disclaimers
To the fullest extent permitted by law, TalkingDot is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and without any warranty that the service will be uninterrupted, secure or error-free. We do not guarantee that every message, notification or email will be delivered, or that answers given by chatbots or the answer bot are accurate.
Limitation of liability
To the fullest extent permitted by law:
- TalkingDot will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, goodwill or data, arising out of or in connection with these Terms or the service;
- our total liability for all claims relating to the service is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or one hundred US dollars (USD 100).
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep any rights that the law of your country gives you and that cannot be waived by contract.
Indemnity
You agree to defend and indemnify TalkingDot against claims, damages, losses and expenses, including reasonable legal fees, arising from your content, your use of the service in breach of these Terms or the law, or your handling of Customer Data, including any failure to provide a privacy notice or obtain a required consent.
Governing law and disputes
These Terms, and any dispute arising from them or from your use of TalkingDot, are governed by the laws of the country where TalkingDot is established. Unless that statement names particular courts, the courts of that jurisdiction have exclusive jurisdiction. Mandatory consumer protection laws of the country where you live still apply where they give you more protection.
General
- Entire agreement. These Terms and the policies they refer to are the whole agreement between us about the service.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours to a successor that continues to provide the service.
- Notices. We send notices to the email address on your account. You can send notices to support@talkingdot.com.
